Lower unit rebuild

My lower unit is shot. Case is good though. No lube but pressurizes and no one wants to take the blame. So I'm screwed. Who is the best at rebuilding a 06 Merc 40hp 4 stroke? Been thinking about sending it out to Kansas for rebuild price of $1000 - $1500. Would like to keep it local if there is any one in town that can do it. New the damn thing costs $3000. Only if I had a 250hp 2 stroke the price comes down quickly.

Have you tried taking it to a merc dealer to try to get it warrantied? That 4 stroke should have a 3 year warranty. Even if it is over the three years, I have had them warranty stuff like that in the past. May save you some money. Do you know how it happened?

It has never been serviced besides the one oil change I did on it. Bought it at Southwest but they said no records of service. Merc said no warranty bc it has 86 hrs on it and it would have burnt up way before that if it left the factory that way. Some where someone didn't put lube in it and I have to pay for it. Bummer for me.
BTW thanks for the replies.

If it never had lube in it, it wouldn't have lasted you 86hrs. Just because you have no records of service, and you only have 86hrs, doesn't mean that mercury won't cover it. If you don't do your 20hr service, it will not void your warranty. As long as you don't have a bent prop shaft or anything that would cause a leak that is not a manufacturing defect you can get it covered.
I tried multiple times. Called Merc myself along with Open Throttle Marine. Merc won't budge on the warranty, no bent prop or anything.

Well I called mercury and asked them about it, they said if it was water intrusion caused from a leaky seal or something of that nature, they would cover it. I just told them about your situation and the guy I talked to said it would be no problem. What exactly happened to trash the lower unit? More info would be helpfull, then I can see if I can help you out.
