Sunday night Aug. 9, Williams Field & Market Place, Gilbert. An off duty police officer confronted a woman who was suspected of shop lifting. He had waited until she was in the parking lot and started asking her a few questions. The female went beserk and took several swings before being knocked to the ground. At this point a man got out of his car and started hollering at the officer as he moved towards him. The officer told the man he had a gun, but he continued forward. The woman rose to here feet and started to hit the officer and in turn the man quickened his pace towards the officer. The officer drew his weapon and fired a shot into the mans groin, but even after going down, the man still made lunges towards the officer. A squad car finally arrived to assist and the woman was cuffed while ther man was attended to.
As more officers arrived, it was determined that the man was in fact the females boyfriend. She will get some jail time and possibly her boyfriend, on top of being shot. All because she thought she was being smart by stuffing some small items into the waist of her jeans. Too bad her top was a little too snug and did very little to conceal these items.

I thought this was going to end where the cop goes to jail...

they said on the news the other night that charges have been dropped against both suspects as the officer has refused to talk with investigators as to what happened. they did not elaborate on the "refused" to talk?? they did show video from the walmart showing the suspects going after the officer.

I would guess under advisement from his attorney.
What would have happened to the guy (hypothetically speaking) sitting in his car watching a lady leave the store. This guy comes up and starts harassing the lady. From what he sees the lady is being attacked. Then some dude comes to help. The crazy man beating the lady pulls out a gun and shoots the guy trying to help the lady. So the guy in the car watching the whole thing go down pulls his gun and shoots the "crazy guy" for fear that the guy was going to kill some one. In court, what would happen?
RYCO I am almost certain the cop was in uniform, but was technically off duty at that time. But I can definatly understand your argument if the cop was in civilian clothes.

oh.. i didnt know he was in uniform. thats a different story then.
According to a witness, he was not in uniform and was at the store with his wife, tho this could be wrong. Hypothetically or for real, if the third guy pulls his weapon and fires, his ass is grass. Only if his life was threatened and he fired in "self defense", would he have a chance of being cleared. Anyone in that situation would do best to use his/her head, call 911, lay low and only observe.

isnt it in fear of our life or those around you? (if hes shooting at him, if he sees me and has a shot he might shoot me too. id be in fear of my life. if i see some one shoot at you and i shoot them and kill them was it justified? LEO's? what about the guy a few years back who was minding his own business and there was a situation where another guy was open firing on the cops, the dude minding his own pulled his gun and shot the dude shooting at the cops and he got an award for it. ( this is a story i heard happened, it didnt happen to my uncle or anyone i know.) i heard it happened in phoenix.
Show of legal force in a property crime is legal, use of legal force is not. Thats why I am guessing, and I am guessing, that the officer may have become invovled in something that is not clear. He was trying to stop a property crime that escalated. And I think thats where the grand jury has to make the destnction. And also why he is not saying anythiing. Now the proof is on the prosecutor as to wether he was legal or not. This is exaxctly why intervening should not be taken lightly. Or anytime you decide to draw a weapon.
I agree. Now lets say hypothetically as Ryco put it, a third party drew their gun and fired at the person they thought was assaulting the woman. Even unknowingly, this person would now be charged with deadly assault on an officer. If the officer would have been wounded or worse, this guy would be toast. Lately I have seen a lot of "plain clothed" officers around and even had a detective as a neighbor. On the street or in a parking lot, it would be hard to say if they are pd or a regular joe.
There are laws in place for "Third party rescue" but you had better know the person you are helping and everything that is going on otherwise you can end up on the wrong side of the bars very quickly. This information is directly from the instructor at my CCW class.
The first question to ask is if the officer identified himself as such. My guess would be that he did...
